Designation of Personnel Authorized to Act for the Department under the Forest Conservation Act of 1991. Natural Resources Article, Section 5-1601, et seq.

I. Purpose
The Department, acting through the Secretary of Natural Resources, is authorized by the Forest Conservation Act of 1991 to undertake certain actions and to approve certain activities of local governments to implement the statute. Specifically, under Section 5-103 the Department is empowered to review and either approve or disapprove local forest conservation programs required to implemented by local governments having planning and zoning authority. Also, under 5-103 the Department may or may not concur in the assignment by a municipality with planning and zoning authority of its responsibility to adopt a local forest conservation program to the county in which it is located. In the absence of a local forest conservation program, the State forest conservation program, administered by the Department, will go into effect on January 1, 1993. The State forest conservation program will go into effect on July 1, 1992, for any sate agency or state-funded project as defined by statute and implementing regulations at COMAR 08.04.01.II. III. Policy Delegation of Authority/Forest Conservation Act
The following individuals are authorized by the Secretary to act for the Department to implement each of the responsibilities and authorities described in the preceding paragraph:Secretary of Natural Resources,
Assistant Secretary for Resource Management
Director, Forest Service
Program Manager, Urban and Community Forestry
IV. DURATION OF DELEGATION:
This designation of authority shall remain in effect until rescinded or amended by a subsequent order. This designation of authority may be re-delegated by the Assistant Secretary and the Director of the Forestry Division.
